In 2018, Josh Hicks praised a ruling by the Kentucky Supreme Court that freed people to file lawsuits over medical malpractice claims, calling it a “rejection of corporate and special interests and a win for the common man or woman injured or killed by the negligence of others”

o      In a Nov. 15, 2018, Facebook post,  Josh Hicks wrote, “This is a huge decision by our Kentucky Supreme Court. A rejection of corporate and special interests and a win for the common man or woman injured or killed by the negligence of others. Paul Casi II and Guthrie True fought (and won) for everyday folks over big corporate dollars.”[1]

o      In an Nov. 15, 2018, article, the Courier-Journal reported, “In a ruling that frees people to file lawsuits over medical malpractice claims, the Kentucky Supreme Court on Thursday struck down a 2017 law that required people to first submit their cases to an outside panel for review.

 

“In an opinion written by Chief Justice John Minton, the court found the ‘Medical Review Panel’ law to be unconstitutional because it obstructs access to the courts.”[2]
